Veterans who have tried to claim their full disability benefits, without legal assistance, already know how frustrating and complicated that process can be. Much to often there are scandalous delays that can last years while the veterans are left injured and unemployed.

Unfortunately, even more common is the veteran who receives a 10% or 20% disability rating for one injury, while another injury is completely ignored, denied, or improperly determined to be "minor," when in fact it was a "major" or "severe" injury, requiring a much higher rating.

Eligibility for most VA benefits is based upon discharge from active military service under other than dishonorable conditions.

Active service means full-time service, other than active duty for training, as a member of the Army, Navy, Air Force, Marine Corps, Coast Guard, or as a commissioned officer of the Public Health Service, Environmental Science Services Administration or National Oceanic and Atmospheric Administration, or its predecessor, the Coast and Geodetic Survey.

It may seem hard to believe, but prior to June 20, 2007, it was illegal in this country for a veteran to hire an attorney to help in their claim for disability benefits within the VA system.

After years of fighting, you now have some of the same rights long provided civilians in their fight for disability claims under Social Security. You are no longer forced to accept the Veteran Administration's evaluation and decision regarding your injuries. You can now obtain a legal assessment of your case by an accredited attorney.

The Veterans Administration has very stringent laws that determine if they are going to give you the benefits you earned - and the specific amount of benefits you will receive.

The Veterans Service Organizations (VSO's) have been assisting and representing veterans in their claims against the VA for many years at no charge to the veteran.

We would prefer say at no cost to the veteran but, unfortunately, there is a cost.
